| 中國人的「一諾千金」在現代生活中已經不復見了。現代人無論 事情的大小好像都要靠一張合約來相互的約束。即使像Microsoft這麼大的公司還是有可能和人家產生合約的糾紛。所以當你簽訂合約內容的時候，真是要 逐字逐句好好斟酌。如果你對合約的內容有任何問題的話，一定要問清楚："Does what it says here mean that...?"請問你這項條款的含意是..."Does what it says here mean that...? " 比較通用於商業上的洽談中，是語氣上比較小心謹慎的說法。比較口語化及常用的說法是："Does this mean that...?"「這是代表甚麼意思呢？」舉個例子："Does this mean that I can´t get my money back?"「是否這表示我沒有辦法把我的錢拿回來嗎？」 |
| 對話 A：Before we sign this contract, may I confirm a couple of things? 甲：在我們簽訂合約之前，我可不可以確定幾項事情呢﹖ B：Yes, of course. What are they? 乙： 可以，當然可以。是甚麼呢﹖ A：Does what it says here mean that resid uals should be paid? 甲：這兒寫的，是不是表示要付節目重播費用呢﹖ B：That´s right. 乙：對。 A： And here, does it mean that the contract should be renewed only upon your request? 甲：還有這兒，是不是指合約只有在你們提出要求的情況下才可以續約呢﹖ B：That´s correct. 乙：對。 |

| 簽署合約必須小心 合約一旦簽署，一切就告確定，無可反悔。確定協議、交易等，英文叫做clinch a deal，例如：By signing the contract, they clinched the deal.（他們簽署合約，確定了這宗交易。）簽署合約之前，當然要每項條文都徹底明白，否則就應問清楚。假如你表示要徵詢律師意見，或要求對方闡明一些 細節，對方可能說：Okay, you can´t be too careful about what is detailed in the contract. 這是甚麼意思呢？ 假如你以為他是說：「好吧，但你對合約的細則不能太過小心。」那就錯了。You cannot be too careful. 即「你怎樣小心都不能(can´t)算是(be)過份小心(too careful)」，換言之，你必須非常小心。這can´t....too句式，在華人社會裡常被誤解，應該特別留意。現在謹再舉幾個例子： (1) This clause cannot be stressed too much.（這條款非常重要，怎樣強調都不算過份。） (2) You cannot exaggerate / overemphasize the importance of punctuality.（守時非常重要，怎樣強調都不算誇張）。 (3) I cannot recommend him too highly for the post.（我認為他擔任此職，非常適合。） 讀者也許會問：如果要說「不必太過強調守時之重要」等，英文怎麼說？答案是用need not、must not代替cannot，例如：You must / need not exaggerate the importance of punctuality. |
